Terms of Service

1. Services

Haul & Hustle ("we," "us," "our") designs and builds a website for the client ("you," "your") and, unless otherwise agreed in writing, hosts that website on our infrastructure for the term of your service agreement.

2. Domain Ownership

You are responsible for registering and owning your domain name through your own registrar account (e.g., Namecheap, GoDaddy, Google Domains). We do not register, hold, or control domain names on your behalf. If we assist with registration, the registrant contact will be set to you, not us.

3. Hosting

• Hosting is included in your monthly service fee of $299/mo.
• Hosting includes uptime monitoring, minor updates, and basic technical support.
• Hosting does not transfer ownership of the underlying code or design to any third-party host. If your service ends, a new site build or a buyout (Section 6) would be required to move elsewhere.

4. Payment

• The $299/mo service fee is due on the 1st of each month.
• If payment is more than 15 days past due, your website will be taken offline until the account is brought current.
• Non-payment beyond 30 days may result in termination of service and removal of the site.

5. Termination & Offboarding

• Either party may terminate this agreement with 30 days' written notice.
• Upon termination, your website is taken offline and your license to use it ends (Section 6). We are not obligated to provide the underlying site files unless the buyout option is purchased.
• We are not obligated to migrate or re-host your site with another provider.
• Your domain remains yours and is unaffected by termination, since it is registered in your own name (Section 2).

6. Content & Ownership

Haul & Hustle retains ownership of the website design, code, and underlying files created for you. Your monthly payment grants you a license to use the site for as long as you remain an active client in good standing — it is not a sale or transfer of the code or design.

If your account is terminated, cancelled, or falls into non-payment beyond the grace period above, your license to use the site ends and we are not obligated to provide the site files to you.

Buyout option: if you'd like a full copy of your site files and a release from this license — for example, to self-host or move to another provider — we offer this as a one-time buyout for $999.

Text, photos, and business information you provide to us (your logo, business name, photos, testimonials, and similar materials) remain your property regardless of this section.

We retain the right to feature completed work in our own portfolio and marketing materials, unless you request otherwise in writing.

7. Lead Data

• Leads submitted through the contact/quote form on your website are captured through our CRM and automatically forwarded to you by text and/or email in real time. You do not receive a login or dashboard to our CRM.
• Leads generated through Facebook or Google ad campaigns we manage on your behalf are viewable directly in your own Facebook Ads Manager / Google Ads account, to which you'll be given access.
• Lead and contact history captured through our CRM remains in our system and is not transferred to you upon termination. Automated lead forwarding stops when your account is terminated; historical lead data may be included as part of the buyout option in Section 6, at our discretion.

8. No Uptime Guarantee & Liability

We strive for high uptime but do not guarantee 100% availability. We are not liable for lost business, leads, or revenue due to downtime, third-party outages, or issues outside our reasonable control. Our total liability under this agreement is limited to the fees you paid us in the preceding three months.

9. Changes & Revisions

Minor content updates (text and image swaps) are included, up to two requests per month. Larger redesigns or new features are quoted separately.

10. Governing Law

This agreement is governed by the laws of the State of Washington.
